If you file the petition jointly with your spouse, do it during the 90-day period before your conditional residence expires. It is possible to file the form without your spouse if they are deceased, you are divorced, or you or your conditional resident child was subjected to extreme cruelty. In this case, you may file a petition at any time after you have obtained conditional resident status.
