Free Real Estate Power of Attorney Forms and Templates

A Real Estate Power of Attorney is a document that allows an individual to select themselves an agent, giving them certain powers relating to properties. A Power of Attorney for Real Estate allows the designated agent to act on behalf of the individual (known as the principal) and make decisions in their best interests. The specific conditions are all outlined in detail within the document. Often this will include matters regarding mortgages and the sale or rent of a property.

The agent is decided upon by the principal and in most cases, a principal will opt to select a close family member or friend. The reason for this is fairly obvious, the principal has to trust the agent to carry out the agreed powers in a fair way, representing the best interests of the principal and not working against them. It is also for this reason that the information regarding the powers must be written as clearly and as detailed as possible. This will prevent the agent from trying to use the document in a manipulative manner.

The property or properties for which the powers can be exercised must also clearly be written out and described along with the start and end date of the document. Any other additional conditions relating to the termination of the document should also be outlined in the document itself.

Real Estate Power of Attorney Template By State

Drafting up the document is unfortunately not enough. There may be various requirements when it comes to signing the document. These will often vary depending on the state and could require a notary public and/or one or several witnesses. In order for the document to be considered legally binding and for it to be accepted, these signing conditions must be obeyed.
