What Is a South Carolina Bill of Sale?
South Carolina Bills of Sale are documents filled out and signed to record the sale and purchase of all kinds of products in the state of South Carolina. Usually, these documents can be subdivided into four main types:
- Generic. The form is used during the sale of any generic item within the state, like furniture, electronics, bikes, livestock, and other goods that do not require a specific bill of sale. The completion of this document is not obligatory;
- Vehicle. This type of document is completed to substantiate the sale of a vehicle. The State of South Carolina does not offer any legal form you can use for this purpose. The former DMV Form 4031, Bill of Sale is outdated at present;
- Boat . South Carolina Boat Bill of Sale is a required document filled out every time you buy or sell a watercraft in South Carolina. It is completed as a part of the Watercraft/Outboard Motor Application issued by the South Carolina Department of Natural Resources. Both the seller and the buyer must keep a copy of this document;
- Firearm. The state laws do not require signing any special form during the gun transfer. However, both the seller and the buyer often prefer to do it in order to record all the important details of the deal and to protect themselves against any future fraudulent claims.
If properly completed, the South Carolina Bill of Sale is a legally binding agreement that substantiates the fact of sale and contains a lot of information important for both the seller and the buyer.
How to Fill Out a Bill of Sale in South Carolina?
Except for the Boat Bill of Sale that is a part of an officially issued application and must be fully completed and notarized, this document has no special completion requirements in South Carolina. Non-official forms may include a various number of sheets and sections depending on the situation. In most cases, any Bill of Sale in South Carolina includes:
- Names and physical addresses of the seller and the buyer. If the deal includes more than one seller or buyer, their personal information must be included as well;
- The detailed description that helps to identify the sold item. The description should contain the make, model, year, size, any identification number, and other applicable information;
- Description of the defects the transferred item has. The seller has to inform the buyer about the defects the item has (if any) and to list these defects on the bill of sale. It must be done to avoid any possible accusation of fraud;
- Details of the deal. At a minimum, the document must contain the date of sale and the sales price. If there are any additional terms, include them as well;
- Signatures of all parties of the deal.
The certification by a notary public is not required for non-official forms. However, you may notarize your document for extra protection.
