What Is a Delaware Bill of Sale?

A Delaware Bill of Sale is the legal agreement between two parties about the transfer of ownership of any property, including vehicles, livestock, firearms, watercraft, and others. This document usually contains a brief summary of the deal (date of sale, conditions, and price), information that helps to identify the transferred item, and information about the buyer and the seller. In some cases, it may require notarization.

This form is filled out to record the transfer of personal property from the seller to the buyer. You can use it to buy or sell various items, including jewelry, tools, electronics, home appliances, furniture, and others.

All Delaware Bills of Sale can be divided into four main types:

  • Delaware Generic Bill of Sale. You can fill out this document any time you sell or buy any property in Delaware;
  • Delaware Vehicle Bill of Sale. This form is typically completed during a car transfer and contains a description of the transferred vehicle, including its identification number and odometer readings in miles;
  • Delaware Boat Bill of Sale. You need this document when you buy or sell a watercraft. The form must be signed in front of a notary public, otherwise, it will not be accepted as a legal document by Delaware officials;
  • Delaware Firearm Bill of Sale. You are not legally required to fill out the form during the transfer of firearms.

The State of Delaware does not provide any government-issued forms for either these documents. You can use the basic templates we offer and customize them according to your needs while following the Delaware Bill of Sale requirements.

The only government-issued Bill of Sale within the state is the Horse Bill of Sale provided by the state's Department of Agriculture.

Do You Need a Bill of Sale in Delaware?

In most cases, you will not need to fill out any forms when transferring property in Delaware. The only exception is the Boat Bill of Sale which is required for registering watercraft. According to state requirements, this form must contain a full description of the transferred vessel and be notarized. A properly completed free-form Vehicle Bill of Sale can also be used to receive a temporary tag for a car you have bought in Delaware.

In all other cases, this document is not required by the state authorities. However, you are recommended to fill it out since it can:

  • Prove that you are the new owner of the described item (if you are a buyer);
  • Serve as evidence that you do not own the property any longer and are not responsible for its use;
  • Serve as a purchase receipt.

A Bill of Sale in Delaware requires no notarization, except for the two forms mentioned above, but you may use a notary public certification as an additional layer of protection for your transaction.
